In order to participate in any Sun Turtle SUP activities, each paddler must first read and agree to the following terms and conditions (by completing the form below). Activity waivers such as this are a standard – but important – requirement for all adventure sports, including SUP. Please do not hesitate to contact us if you have any queries or concerns.
Activity Risk Waiver (“waiver”) –
Between: the participant (“participant”) and Janek Dubicki and/or Daniel Kilburn operating as Sun Turtle SUP (“provider”) in consideration of being permitted to participate in stand up paddle activities (“the activity”) now and in the future.
The participant understands and accepts that their participation in this activity poses known and unknown risks and dangers – to themselves and to third parties – that could result in physical and emotional injury, damage to property or equipment, or death. The participant assumes and accepts responsibility for their safety and the safety of others at all times while participating in the activity.
The participant releases and forever discharge the Provider, their agents, contractors, employees, volunteers, partners, participants, affiliated entities and representatives from any claims or liability for or by reason of injury to person or property – including that may result in death – sustained as a consequence of the participation in the activity.
The participant acknowledges that the activity requires a reasonable level of fitness and the ability to swim 50m in open water conditions. The participant acknowledges that they do not have any medical conditions or physical limitations that would limit their participation in the activity or pose a risk to themselves or others. The participant will declare any relevant conditions or limitations to the instructor in advance. The participant will not participate in the activity while under the influence of alcohol or drugs.
The participant acknowledges that the Provider will offer the necessary safety instructions and briefing in relation to the activity and warrant that they will comply with all instructions at all times. The participant acknowledges that the activity may be undertaken without direct supervision. The participant agrees to wear any protective or safety equipment provided (specifically buoyancy aid and leash). The participant warrants that they will only paddle within their ability level and exercise judgement during the activity.
The participant warrants that they will be over the age of 18 on the date of the activity. The participant warrants that they will comply with any height, weight, and age restrictions that may be required. Violation of any of these terms will result first in a warning and then subsequently in removal from the activity. The participant acknowledges that they may not be able to partake in the activities if they do not comply with the restrictions and requirements of this waiver.
In the absence of any negligence or other breach of duty by the company or its servants and agent, you will be responsible for any loss, theft, injury or damage, however incurred whilst undertaking the activity or on the premises used by the Provider.
The participant expressly agrees and promises to accept all risk arising from the activity and warrants that their participation is voluntary and that they elect to participate despite these risks.
